Privacy Policy

1. Scope

This privacy policy informs data subjects about the nature, scope and purposes of the processing of personal data on the website futureroundnet.com and on all subpages accessible under that domain, in accordance with Art. 13 and Art. 14 of Regulation (EU) 2016/679 (General Data Protection Regulation, hereinafter "GDPR").

It does not extend to websites operated by third parties which are accessible by way of hyperlinks from this website, nor to the processing of personal data in the context of a package travel contract concluded with the controller, which is governed by section 14 of this policy and by the General Terms and Conditions referred to therein.

2. Definitions

The terms used in this privacy policy have the meaning assigned to them in Art. 4 GDPR. In particular:

  • Personal data means any information relating to an identified or identifiable natural person (Art. 4(1) GDPR).
  • Processing means any operation performed on personal data, whether or not by automated means, including collection, recording, storage, use, disclosure by transmission and erasure (Art. 4(2) GDPR).
  • Controller means the natural or legal person which, alone or jointly with others, determines the purposes and means of the processing (Art. 4(7) GDPR).
  • Processor means a natural or legal person which processes personal data on behalf of the controller (Art. 4(8) GDPR).
  • Consent means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which they signify agreement to the processing (Art. 4(11) GDPR).
  • Third country means a country outside the European Economic Area.

3. Controller

The controller within the meaning of Art. 4(7) of Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR") is:

As the controller is established in the Slovak Republic, the processing described below is governed by the GDPR, by Act No. 18/2018 Coll. on Personal Data Protection and, with regard to electronic direct marketing and to information stored on or accessed from terminal equipment, by Sections 109 and 116 of Act No. 452/2021 Coll. on Electronic Communications.

A Data Protection Officer has not been appointed. The requirements of Art. 37(1) GDPR are not met: the controller is not a public authority, its core activities do not consist of regular and systematic monitoring of data subjects on a large scale, and no large-scale processing of special categories of data takes place. Enquiries concerning data protection should be addressed to the contact details above.

4. Categories of data, purposes, legal bases and retention

This website contains one form, the FRESH 27 email signup. Beyond that, personal data is processed only where you contact us by email or where your browser requests a page.

No date of birth, postal address, payment data or special categories of personal data within the meaning of Art. 9 GDPR are collected on this website.

5. Email list (FRESH 27)

5.1 Signup procedure

Data entered into the signup form is transmitted to an interface operated on our own server and forwarded from there to our email service provider. No data is stored on the website itself and no access credentials are contained in the page. In addition to the data you enter, the page on which you signed up and the date of signup are recorded.

5.2 Content of the emails

The emails concern FRESH and Future Roundnet: dates, accommodation, prices, the opening of registration and occasional editorial content about the sport. Third-party advertising is not sent, and email addresses are not disclosed to third parties for their own marketing purposes.

5.3 Withdrawal of consent

Each email contains an unsubscribe link. Consent may also be withdrawn at any time by email to contact@futureroundnet.com, without giving reasons and free of charge. Withdrawal does not affect the lawfulness of processing carried out before it (Art. 7(3) GDPR).

5.4 Measurement of email performance

Our email service provider records whether an email has been opened and which links it contains have been clicked. Where an email contains a button by which recipients can express interest in a camp, a click on that button is recorded as an expression of interest. No scoring, profiling or automated decision-making within the meaning of Art. 22 GDPR takes place, and the data is not disclosed to third parties. Not clicking has no consequences and does not affect the recipient's inclusion on the list.

The legal basis for sending the emails is consent pursuant to Art. 6(1)(a) GDPR in conjunction with Section 116(3) of Act No. 452/2021 Coll. In relation to former participants of a FRESH camp, emails concerning our own similar services may additionally be based on Section 116(15)(a) of that Act and on our legitimate interests pursuant to Art. 6(1)(f) GDPR. The legal basis for measuring email performance is our legitimate interest in assessing the effectiveness of our communications, Art. 6(1)(f) GDPR. You may object at any time pursuant to Art. 21 GDPR using the contact details in section 3.

5.5 Processor

Emails are sent and contact data is administered by Sendinblue SAS, trading as Brevo, 17 rue de Salneuve, 75017 Paris, France, RCS Paris 498 019 298, acting as a processor pursuant to Art. 28 GDPR on the basis of the Data Protection Agreement set out in Appendix 3 to its Terms of Service. The provider is established in the European Union and stores the contact list within the European Union. Where the provider engages sub-processors outside the European Economic Area, it does so subject to the safeguards set out in that agreement.

6. Encryption and hosting

6.1 Transport encryption

This website uses TLS encryption for all connections. Data transmitted between the user's browser and the server cannot be read by third parties in transit. An encrypted connection is indicated by the prefix "https://" in the address bar of the browser.

6.2 Hosting

This website is hosted on a virtual server operated by the controller at Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in a data centre located in Nuremberg, Germany. The hosting provider acts as a processor within the meaning of Art. 28 GDPR. Personal data processed in the course of hosting does not leave the European Union.

7. Server log files and reach measurement

Each page contains a one-pixel image which is requested from the same server that delivers this website. That request is written to a log file together with the IP address, the page requested, the referring page and the browser identification. The website is hosted by Hetzner Online GmbH in a data centre in Nuremberg, Germany.

The following applies to this processing:

  • No cookies are set for this purpose, either by us or by any third party.
  • No third-party service is involved; the data does not leave our own server.
  • No cross-site tracking takes place and no user profiles are created.
  • Evaluation is carried out in aggregate form per page.

An IP address constitutes personal data. The legal basis for this processing is our legitimate interest in the secure operation and needs-based design of this website, Art. 6(1)(f) GDPR. You may object at any time pursuant to Art. 21 GDPR using the contact details in section 1.

Retention. Log files are currently retained for up to 400 days. This retention period is being reduced to 30 days, and IP addresses will be truncated at the point of collection. This policy will be updated accordingly once the change has been implemented.

8. Recipients and categories of recipients

The following recipients may receive personal data in connection with the use of this website. The list was compiled from the source code actually delivered to browsers.

Fonts, scripts and the map displayed on the home page are delivered from our own server. Calling up a page therefore does not involve any content delivery network, font service or analytics provider.

Links to Instagram, YouTube, Twitch, Spotify and other services are simple hyperlinks. No data is transmitted to those services until the link is followed; thereafter the privacy policy of the respective provider applies.

9. Transfers to third countries

Email addresses remain within the European Union. Transfers to the United States may occur in the two cases set out in section 8, each of which requires an act by the user: starting the video on the FRESH page, or calling up the athlete roster.

Vimeo.com, Inc. and GitHub, Inc. are certified under the EU-U.S. Data Privacy Framework, in respect of which the European Commission has adopted an adequacy decision. Those transfers therefore take place on the basis of Art. 45 GDPR.

10. Cookies and similar technologies

This website does not set cookies of its own, whether for analytics, advertising or recognition purposes, and no information is stored on or read from your terminal equipment when a page is called up. For this reason no consent banner is displayed: consent pursuant to Section 109(8) of Act No. 452/2021 Coll. is required only where information is stored on or accessed from terminal equipment.

The video embedded on the FRESH page constitutes an exception. It is displayed as a still image and is not loaded until the user starts it. Once started, the player is loaded from Vimeo, which may then set its own cookies. Starting the video constitutes consent to this, and a corresponding notice is displayed adjacent to the play button.

11. Rights of the data subject

You have the following rights in relation to personal data concerning you:

  • Right of access, Art. 15 GDPR
  • Right to rectification, Art. 16 GDPR
  • Right to erasure, Art. 17 GDPR
  • Right to restriction of processing, Art. 18 GDPR
  • Right to data portability, Art. 20 GDPR
  • Right to object to processing based on legitimate interests, Art. 21 GDPR; this concerns the processing described in sections 5.4 and 7
  • Right to withdraw consent at any time with effect for the future, Art. 7(3) GDPR

Requests should be addressed to contact@futureroundnet.com and will be answered within one month of receipt in accordance with Art. 12(3) GDPR. No particular form is required.

12. Right to lodge a complaint

You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or of the alleged infringement (Art. 77 GDPR).

The competent authority for the controller in data protection matters is the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava, Slovak Republic.

In matters concerning unsolicited electronic communications and information stored on terminal equipment, the competent authority is the Regulatory Authority for Electronic Communications and Postal Services, Továrenská 7, 828 55 Bratislava, Slovak Republic.

13. Obligation to provide data

The provision of personal data is neither required by law nor by contract for the use of this website. Providing an email address is voluntary and is not a condition for participation in any offer; the dates, accommodation and price of the camp are published on this website at the same time as they are sent by email.

No automated decision-making, including profiling, within the meaning of Art. 22 GDPR takes place.

14. Bookings

This privacy policy covers the use of this website. The booking of a place at a FRESH camp is a separate contractual relationship and is governed by a separate document.

Booking requires data which this website does not collect, in particular a postal address, identity card or passport details for the purposes of accommodation registration, and payment data. That processing is based on the performance of the contract rather than on consent, and involves further recipients, namely the accommodation provider, an insurer and public authorities where required by law. Details are set out in Article VIII of the FRESH General Terms and Conditions, which are provided with the booking documents and which govern the package travel contract pursuant to Act No. 170/2018 Coll.

15. Amendments to this privacy policy

This privacy policy is amended where changes to our processing operations or to the applicable legal framework require it. The version date at the top of this page is updated accordingly. Where an amendment affects processing carried out on the basis of consent already given, data subjects will be informed by email.
